FAA Section 333 Exemption and the ELEV-8 V2

Does anyone know of any Section 333 exemptions that have been granted that list the ELEV-8 V2 quadcopter as one of the authorized UAS?

    I have not read all of Section 333 yet, but are you asking about commercial operation?

    The ELEV-8 fits into the .55 lbs to 55 lbs category, but commercial operation requires paper registration.

  • Any commercial use requires an FAA section 333 exemption. All of the requests and petitions granted can be viewed on the FAA website. If you look at the petitions/requests for FAA Section 333 exemptions and the related letters from the FAA (granting any given exemption), the specific makes and models of the UAS associated with any given exemption are listed (i.e. each time a person or organization requests exemption, they must list the specific makes and models of UAS they are seeking authorization to use if/when the FAA grants the exemption ... for example, DJI Phantom 2 Vision+). If the FAA hasn't granted a previous exemption with the associated make and model UAS in a prior application, I believe there is an additional procedure that needs to occur in order to the FAA to approve the application. My previous question in this forum pertained to the Parallax ELEV-8 V2 and whether anyone knows of any exemptions that have been granted that list this make and model of UAS in the petition.

    Here are some examples of how this works (quoted from a recently granted FAA Section 333 exemption):


    "Conditions and Limitations ..... Operations authorized by this grant of exemption are limited to the 3DR X-8, SenseFly eBee, and DJI Phantom 1 when weighing less than 55 pounds including payload. Proposed operations of any other aircraft will require a new petition or a petition to amend this exemption."

    "The UAS proposed by the petitioner are the 3DR X-8, SenseFly eBee, and DJI Phantom 1. In accordance with the statutory criteria provided in Section 333 of Public Law 112−95 in reference to 49 U.S.C. § 44704, and in consideration of the size, weight, speed, and limited operating area associated with the aircraft and its operation, the Secretary of Transportation has determined that this aircraft meets the conditions of Section 333. Therefore, the FAA finds that relief from 14 CFR part 21, Certification procedures for products and parts, Subpart H—Airworthiness Certificates, and any associated noise certification and testing requirements of part 36, is not necessary."

    As of this month, the Parallax ELEV-8 v2 Quadcopter Kit has been approved by the Secretary of Transportation under Section 333 of the 2012 FAA Modernization and Reform Act. Please see my forum post for details.
