Whose trademark? Whose copyright?
Parallax doesn't seem to assert an trademark ownership by a 'circle R' or a 'TM' on their products. And one individual claimed the copyright the Propeller Beanie in the 1940s, though his version has a visor as you have displayed.
The robotic blue cat from the future in Japan, Doremon, seems to fly by means of a device that might ... with a stretch... be considered a propeller beanie.
About all that can be said is that when you do something successful, people will copy you. So I guess Parallax should just accept the compliment.

One cannot make Parallax tilt at windmills that they choose to ignore.
