It appears that M$ and Apple think they can buy market control via a legal battle.

Of course, the customer suffers. When are these guys going to be subject to Anit-trust laws?

Say M$ successfully wrecks Android via strong arm tactics...
Who are they going to tick off? A lot of very young consumers!
And how will all those young consumers feel about buying M$ products in the future?
Laws only have power if someone is willing or rich enough to enforce them. So if a legal battle is going to take 3 years then a company is only going to fight it if it is financially viable.
And in this case, the "someone rich enough" are the ones responsible for it!!
A rich company could get the Justice Department to look into it but its like when I called my member of congress and they said, "We don't work for free."

A patent owner MUST defend the patents, otherwise their investments (whether financial or intellectual) would be wasted, plain and simple. If Google's OS is violating those patents, then they have the right to sue them. (I'm not defending the valadity of software patents... that's a whole different argument... but I am defending the patent system as a whole.)
It seems to me that Google made a stupid mistake not going in with the others on the purchase.
