I'm considering using DS1338 as it comes in a 3.3V package.
DS1307 seems to only be a 5V device (typical operations table).

They seem compatible and DS1338 has better performance (speed & power).

Any thoughts?

Last time I looked, DS1307 was the only one with I2C in a DIP package that would easily work...
In smaller packages, there are tons of options from Dallas and others...

You might want to check out the DS3231. I have one soldered to a Sparkfun 28 pin breakout board I had and it works with Kye's 1307 driver {without changing it} for Date/Time functions. I have been adding the Alarm stuff to Kye's driver to check those functions out (such NICE code to work with!!) - not complete yet.

Thanks guys. I think I'll go ahead and use the DS1338 since i need an SOIC-8. Also I'll probably just use a .1" header for battery backup.
